1. Acceptance of Terms

Aether Voice provides Software-as-a-Service (SaaS) and conversational artificial intelligence services through our platform. The Service offers a free access tier as well as optional paid subscription plans and usage-based voice credits.

We reserve the right to modify, suspend, or discontinue the Service (or any feature thereof) at any time with or without notice.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are solely responsible for:

Confidentiality

Maintaining the confidentiality of your account credentials, API keys, and session tokens.

Account Activity

All operations, telephony sessions, agent tunings, and campaigns occurring under your account.

Immediate Notice

Notifying us immediately of any unauthorized use or security breach of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or present operational risks.

4. Age Requirements

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If we become aware that a user does not meet this requirement, we will promptly terminate their account and securely erase their data.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Aether Voice and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Aether Voice.

User-Generated Content: User-generated content (including prompts, custom agent parameters, audio recordings, and campaign configurations) remains the property of the user. However, you grant Aether Voice a non-exclusive, royalty-free license to use, process, display, and distribute such content solely in connection with operating and delivering the Service to you.

6. Prohibited Uses

You agree not to use the Service:

In any way that violates applicable national, state, or international laws or regulations

To transmit unsolicited commercial voice communications (voice spam, illegal robocalls, or DND violations)

To spoof caller identity or impersonate any person, business, or entity

To engage in any conduct that restricts, disrupts, or inhibits others' use or enjoyment of the Service

To attempt to gain unauthorized access to any accounts, systems, or telephony infrastructure

To deploy automated scripts, scraping, or bot crawling to extract data without authorization

To upload, inject, or transmit viruses, trojans, worms, or other malicious code

7. Payment & Credit Terms

Our Service provides free tier access. If you purchase voice coins, telephone numbers, or subscribe to a paid tier:

Billing: Subscription fees are billed in advance on a recurring monthly or annual basis. Voice coins and credits are billed upon checkout.
Non-Refundable: All fees, purchased credits, and phone number rentals are non-refundable unless otherwise required by law or stated in an applicable refund policy.
Price Changes: We reserve the right to change our pricing or credit rates with at least 30 days' advance notice.
Delinquency: Failure to pay or maintain sufficient coin balance for active telephony services may result in immediate suspension or termination of your phone numbers, agent instances, or account.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express or implied.

Aether Voice expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and telecommunication carrier latency.

We do not warrant that: (a) the Service will function uninterrupted, timely, secure, or error-free; (b) defects or anomalies will be corrected; or (c) the Service or its servers are free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Aether Voice shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, voice transmission failures, data loss, goodwill, or other intangible losses, resulting from your access to, use of, or inability to use the Service.

Liability Cap: In no event shall Aether Voice's total aggregate liability to you for all claims exceed the greater of one hundred US dollars ($100 USD) (or its Indian Rupee equivalent) or the total amounts paid by you to Aether Voice in the twelve (12) months immediately preceding the claim.

10. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof, will be settled and resolved through binding arbitration in India under the Arbitration and Conciliation Act, 1996, except that either party may seek emergency injunctive or equitable relief in any court of competent jurisdiction to prevent irreparable harm.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised "Last updated" effective date.

Your continued use of the Service after any such changes are posted constitutes your binding acceptance of the revised Terms.
